WII skips multi-seasonal study on Etalin, cheats its way to compile a conservation plan; MoEFCC and FAC ignore all FANTASTIC REPORT The Wildlife Institute of India (WII) spent only four months on field while compiling a multi-seasonal replicate study on the Jindals’ 3097 mw Etalin Hydro Electric Power Company Ltd (EHEPCL) in Dibang Valley in Arunachal, and it relied on earlier studies conducted in the region. The forest advisory committee (FAC) of the union ministry of environment, forests & climate change (MoEFCC) and the ministry itself did not bother to ask any questions as to how the study was compiled, even though one of its own reports states that four months’ study was carried out. Instead, the FAC formed a subcommittee to look into the “concerns related to tree enumeration process and the aspects highlighted in biodiversity assessments study by WII.” The wildlife study done by the WII is accepted in toto by the subcommittee, the subcommittee report says. China not to alter course of rivers flowing into Nepal China has agreed not to deliberately change or cause to change the course of any trans-boundary rivers flowing into Nepal. This comes under an Agreement on the Boundary Management System reached with Nepal during the visit of Chinese President Xi Jinping to Kathmandu in October 2019. All the major rivers including the Karnali, Kali Gandaki, Budhi Gandaki, Trishuli, Sunkoshi, Bhotekoshi, Tamakoshi and Arun originate in the Tibet Autonomous Region (TAR) of China. Nepal as well as the northern part of India could be seriously affected if any dams or diversion projects are built in upper riparian Tibet. “Both sides shall, as far as possible, prevent the boundary rivers from changing their courses. Forbidden to step into the water lest he pollute the river with his transgression, he was moved to compose his famous devotional eulogy of the Ganga, known as the Piyushalahari. As he composed each verse, legend has it, the river rose step by step, and at the end of his recitation sweeps him and his devoted wife away.”

On April 16, 2019, Delhi High Court bench decided to initiate a Public Interest Litigation based on a newspaper report that not much rainwater harvesting or groundwater recharge is happening in spite of years of talk that seems to have remained empty. This is a welcome move and one hopes HC takes the issue to its logical conclusion.

In January 2019, the NGT rejected the Centre Groundwater Guidelines for a variety of reasons. It cited several shortcomings, several of which had already been pointed out on this blog, such as the fact that the water conservation fee would give those who had paid it carte blanche to withdraw excessive amounts of water and the lack of monitoring of pollution of groundwater. In addition to the shortcomings cited by the NGT, do the guidelines take into account the special needs of the Himalayan states? Two interesting orders from National Green Tribunal (NGT) marked important developments on water-environment issues this week. NGT asking for PERFORMANCE AUDIT of pollution Control Mechanism is indeed long overdue necessity, considering the complete, abject failure of the pollution control mechanism in India. The hopes of effective action, like in the past, however, were dashed since CPCB, which is PART OF THE PROBLEM has been asked to do the audit. Whatever positive signs were available by this order were further dashed by another NGT order in which it declared that EIAs (Environmental Impact Assessment) reports are already taking climate change into account, while the tribunal dismissed a petition asking that all development activities be screened/ regulated keeping climate change in mind.
This is totally WRONG contention. Just to illustrate, SANDRP has been pointing out to the EAC, MoEF and the developers how the EIAs of dams and hydropower projects are ignoring the climate change related issues and impacts. In response the consultants and developers have responded, approved by the silent or spoken nods by the EAC and MoEF that these were not even part of their TORs! On Dec 12, 2018, The government introduced the Dam Safety Bill amid din in the Lok Sabha on Wednesday even as Biju Janata Dal group leader Bhartruhari Mahtab questioned the legislative competence of the House on the matter.
The Bill provides for “surveillance, inspection, operation and maintenance of specified dams for prevention of dam failure related disasters and to provide for institutional mechanism to ensure their safe functioning”. There are over 5,200 large dams in the country and about 450 are under construction. Himachal Pradesh has received 917.3 mm rainfall during South West Monsoon 2018. The amount is 11 percent higher than normal rainfall category of 825.3 mm. However at district level there is considerable variation in the distribution of rainfall. Out of 12 districts in the state, rainfall departure has been in deficit in three districts namely Chamba, Kinnaur and Lahul & Spiti by 38 percent, 32 percent and 43 per cent respectively. All these three districts are in upper part of Himalaya, the origin of many rivers & where mountains are mostly snow covered.
Uttrakhand has received 3% below normal rainfall during South West Monsoon 2018. Though the figure falls in normal category, however district level rainfall data paints a very different picture. Out of total 13 districts in the Himalayan state, four districts namely Almora, Pauri Garhwal, Tehri Garhwal and Udham Singh Nagar have received deficit rains, whereas three districts which includes Bageshwar, Chamoli and Haridwar have got rainfall in excess. Out of the rest six districts four are on marginally positive side and two are on marginally negative side.
