It’s great to see the top edit in THE TIMES OF INDIA today (Aug 12, 2019) calling for urgent review of flood management in India. Indeed the current floods can be a big wake up call.
TOI Edit rightly says: “Similarly, there’s also an urgent need to upgrade dam management in the region. Despite heavy rain warnings, why couldn’t Maharashtra and Karnataka coordinate to release dam waters downstream as a pre-emptive measure? We need much more proactive and punctilious supervision of dam waters.” Indeed there is need to fix the responsibilities of failures in Dam Management, including forecasting failures, Violations of rule curves, mismanagement of reservoirs and lack of information sharing and coordination. India urgently needs a lot of effective work on Dam Safety, but the bill before the Parliament makes CWC (Central Water Commission) as focal point of Dam Safety, but CWC has conflict of interest and poor track record. The Bill does not provide any real independent oversight, nor clearly defined norms of complete transparency in the dam safety matters, and there is no role of the vulnerable communities, the most important stake holders. The Interstate Amendment Water Disputes Amendment Bill before the Parliament is basically tinkering with the existing system, which will not change anything fundamentally. It needs to be understood that disputes arise when an upper riparian state (or a country) build a large dam or diverts the massive amount of water, leading to lower availability of water for the lower riparian state (or country). When it comes to resolution, the tribunals look at a river as a channel of water and its distribution, ignoring that it is a complete ecosystem and that water in a river depends on the state of its basin and catchment area. It also depends on the extraction of groundwater. These aspects are ignored by the tribunals. Moreover, a state does not represent a river basin or all its stakeholders (the people using river water), which is why the Narmada tribunal’ award created a conflict between the states and their people. The latest update from IMD[i] on Very Severe Cyclonic Storm VAYU (issued at 0700 hrs on June 13, 2019) does not provide any specific risk of floods in any region, nor does it mention any possibility of persistent rainfall leading to risk of floods.
Another IMD update at 1200 hours on June 13, 2019[ii] says large parts of coastal Saurashtra may experience winds of 160 kmph starting June 13 afternoon, but there is no mention of risk of floods. It does give heavy rainfall warning: “Widespread rainfall with heavy to very heavy falls at few places and extremely heavy falls at isolated places in the coastal districts of Saurashtra” till 0830 hrs on June 15, 2019, in RED colour, the highest risk colour code used by IMD. Further this warning adds: “Flooding of escape routes. Minor disruption of railways, overhead power lines and signalling systems.” Among action suggested it lists: “Inundation of low lying areas along the above mentioned coastal districts due to heavy rainfall and storm surge… Evacuation from low lying areas of the above mentioned Districts, coastal Hutment dwellers, urban slum dwellers and people staying in unsafe house to safer places.” The Ministry of Earth Sciences also sends out these releases through PIB Press Notes as IMD functions under MoES. It’s pretty unusual situation in Bhakra, Pong and Ranjit Sagar dams this summer. These reservoirs on Sutlej, Beas and Ravi rivers respectively, allocated to India under Indo-Pak Indus Waters Treaty, are releasing so much water this summer that a significant part of it is flowing into Pakistan, much against the proclamations of the Government. As even NITI Aayog report acknowledged in June 2018[i], there is consensus that India is facing dire water crisis, which will only get worse. This was also predicted by the World Bank way back in their 2006 report called “India’s Turbulent Water Future”. But do we have the institutions that are capable of taking us out of this crisis? Remember the current institutes are at the root of our water crisis.
Imagine you have to forecast flood using a mathematical model run on a Pentium processor; or manage your office with typewriters instead of a desktop! How frustrating isn’t it, to manage an office with the near obsolete typewriter or run a flood forecasting model using outdated Pentium processor? SYNOPSIS: Everyone concerned agrees that India is facing unprecedented and worsening water crisis. Some of the key aspects of water sector challenges include: Lack of reliable water information, need for restructuring of institutions, groundwater lifeline in distress, politicians and institutions pushing more large dams when evidence shows they do not work, the need for attention to maintenance of massive water infrastructure, the increasing footprint of Urban water sector, State of our rivers in general and Ganga in particular, water management for agriculture, governance and changing climate, among others. Unfortunately, these challenges do not seem to get reflected as electoral issues and all parties are equally to be blamed for this. The current Union government has very poor report card on almost every one of the water sector challenges, and its seems like a series of missed opportunities.

As this report narrates, a great volunteer effort is underway in Mumbai to clean up Mithi river. What they have achieved is just about 350 m of clean river, after labouring over weekends for several months. But this is such a daunting task to even venture to start. They have not only started, but made visible progress. Let us hope it will achieve all its objectives.

The Dam Bachao Abhiyaan has been coming up in various forms. They blame the upstream water use in the catchment for dams not filling up. The catchment area could be using the water through groundwater (e.g. Hussain Sagar in Hyderabad), Johads (e.g. Sahibi catchment in Alwar), Tanks (e.g. Cauvery catchment in Karnataka), or check dams (e.g. Gandhisagar catchment in Madhya Pradesh, Bisalpur and Ramgarh catchment in Rajasthan), the latest episode reflected in the news below.
One key question that is never answered is, does the construction of dam extinguish all the rights of the catchment area to harvest and use any water for even basic needs and livelihoods? Does the very existence of the dam make all such water use in the catchment illegitimate? What about the right to water and livelihood of the catchment area? Should dam filling be so sacrosanct as to not allow any legitimate water use in the catchment? Hope the court and the government resolves these issues. Hope there is debate on this to decide in which circumstances there will be legitimacy to such Dam Bachao Abhiyaan.

In a historic judgement, the High Court (HC) of Bangladesh has said that river encroachers cannot run in any elections or get bank loans. The HC also ordered the government to make a list of every grabber in the country and publish the list in the media to expose them to the public. The grabbers include powerful individuals, businesses and, ironically, government offices. The Gazipur City Corporation is among the grabbers, a judicial inquiry has found.
After the verdict, the government now will have to amend the National River Protection Commission (NRPC) Act 2013 with provisions for punishment and fine for river grabbing. The current NRPC Act does not have provisions for punishment. The government must report to the court in six months on its action in this regard. The HC also declared the NRPC as the legal guardian of all rivers and act like their “parents”.
The landmark verdict comes when river grabbing by influential groups seems unstoppable. Often, grabbers return to steal river land soon after being evicted. The HC delivered the judgment in response to a petition by Human Rights and Peace for Bangladesh. The writ petition was filed on Nov. 7, 2016.
