During past one year, the judicial bodies including National Green Tribunal, Supreme Court, various High Courts have passed several orders and made critical observation while dealing with multiple issues afflicting Urban Rivers in India. This report highlights top ten such judicial interventions across India. The stories underline that the responsible agencies particularly pollution control boards and district, state and union governments have been failing miserably in timely and efficient implementation of these judicial orders, some of which are quite remarkable. If the executive bodies do not show right spirit and seriousness in enforcing the existing rules and court orders the state of India’s urban river only go downhill.

In a wise move, the Brihanmumbai Municipal Corporation (BMC) has cancelled Gargai dam project. In its January 2014, submission to Expert Appraisal Committee (EAC), SANDRP had highlighted the adverse impacts of this project on tribal people and Tansa Sanctuary stressing on alternatives including recycling of sewage and rain water harvesting. Finally, now the BMC has scrapped the unjustified project which would have caused felling of 4.5 lakh trees which BMC chief Iqbal Chahal rightly finds pointless in the wake of increasing climate change threats.
It is worth to mention that in February 2020 BMC was learnt reconsidering its Pinjal dam project and exploring other options including waste water recycling. Indeed the BMC is taking right steps. Dams are costly, destructive projects impacting rivers, forests and local people in multiple ways. The demand side management, efficient use of existing water supplies, rain water harvesting and recycling of waste water are among far better alternatives to meet urban water demands.

The July 15 2021 Govt of India notification on Andhra Pradesh-Telangana water disputes is of doubtful legal validity and the Supreme Court urgently needs to examine this. The 2014 AP Regorganisation Act didn’t make provision for the Centre to take over water infrastructure of the two states, which is what effectively the centre has done through the July 15 notification. The Jul 15 notification effectively dismissing powers of Andhra Pradesh and Telangana without any consultations and there is no provision in constitution for this.
There is no doubt that the long lingering water sharing disputes between Telangana and Andhra Pradesh and which was the major reason for the bifurcation of Andhra Pradesh, needs to be resolved. But the blame for not achieving any resolution of the disputes also lies with the Centre, the KRMB and GRMB are not even functioning with necessary urgency or effectiveness.

In a remarkable new report, the 50 top scientists of Inter-Governmental Panel on Climate Change (IPCC) and Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem Services (IPBES) have come together to deliver the first ever joint collaboration report with the message that Biodiversity crisis and climate change crisis are not independent of each other. The message from scientists is clear: The claimed Climate “solutions” that hurt biodiversity or their habitat are false solutions.
By protecting and restoring nature, the report said, we can safeguard biodiversity, help limit warming, improve human well being and even find protection from the consequences of climate change, like intensified flooding and storms.

A Supreme Court appointed Appeal Forum, appointed as per the SC order in 2012 has directed the Madhya Pradesh (MP) Govt to provide minimum 2 ha land to every displaced family as per the policy. This has raised hopes for just rehabilitation for the thousands of people displaced by the Maan dam in Dhar district of MP by the Narmada Valley Development Authority (NVDA). This is a major victory for the three decades long struggle of the affected people, led by the Narmada Bachao Andolan (NBA). The Forum has asked the govt to provide land to the affected in three months. The dam has been constructed on Maan river, a tributary of Narmada. One hopes the displaced get the justice soon as per the orders of the SC appointed appeal forum. Salutes to NBA for this. One hope the Supreme Court will ensure this happens in a just and expeditious way.

Or may be it is a major issue at a number of places. Like in Kishanganj district along Mahananda river in North East Bihar, as the report here mentions. We hope it is. Since floods and how they are managed affect so fundamentally and in so many different ways so many people, it should be an election issue. Particularly when the incumbent Chief Minister Nitish Kumar is fighting to be voted in after being the Chief Minister of the state for 15 years since Nov 2005 (except brief ten month period in 2014-15).
15 years is long enough time to have been able to make at least some dent in flood management. On ground, the situation seems to have only gone worse. It was in this 15 year period that the unprecedented Kosi floods happened after the Kusaha breach in 2008. But the word unprecedented has been used for several more floods in these 15 years, including by Nitish Kumar. He also raised a number of pertinent issues in this period, including impact of Farakka barrage on Bihar floods, need for its decommissioning, Bihar’s right to get Ganga water from the headwaters in Uttarakhand [currently it gets none except during monsoon]. He is currently silent on these issues, but voters and media do not have to be silent.

Mumbai Metropolitan Region (MMR), with annual rainfall in access of 2000 mm, does not do much to harvest the rain. It does not protect its local water bodies. It does not recharge groundwater to the extent it can easily do. It does not reduce its transmission and distribution losses. It does not treat its sewage to recycle and thus reduce freshwater demand. It does no demand side management. And yet it keeps demanding more water, and for that building of more dams and thus pushing more destruction. Without any credible options assessment. It has no water policy or water vision for smart water management.
The proposed Gargain Dam that will lead to destruction of over four lakh trees in 720 ha forest mostly in Tansa Wildlife Sanctuary, is a good example of how Mumbai is fuelling such dam building and destruction. The Rs 3105 Cr project will have many other impacts, including displacement of tribals and destruction of livelihoods for thousands others. It was good to see MID DAY news paper report and EDIT highlighting some of these issues. Will the people of Mumbai Rise up, to stop this destructive dam, being pushed in their names, the way they stood up to save the far fewer Aarey Milk Colony trees?

A new study has shown how powerful the monsoons and their abnormalities are: It’s these abnormalities that ended reigns of multiple dynasties in medieval India, not wars. But the society does not seem to understand this basic reality today, and we are not only doing everything in our power to make the monsoon abnormal through human induced climate and natural world changes, but not even valuing the rainwater in our water policies, programs and practices. The changes we are bringing in natural world is making even the smaller monsoon abnormalities bring catastrophic impacts as the capacities of the people and societies to cope with the changes is decreasing. These studies are another wake up call, if only we were interested one.

For several decades now, groundwater has been India’s water lifeline. It is going to remain India’s water lifeline for long time to come. So when Prime Minister Modi called for people’s movement on water conservation during his MANN KI BAAT Radio program on June 30, 2019 (http://pib.nic.in/PressReleseDetail.aspx?PRID=1576353), the first thing the people would expect the government to do is to acknowledge the reality that groundwater is India’s water lifeline and make the sustenance of that water lifeline as the focus of all National Water Policies, programs and plans.
India also urgently needs a National Urban Water Policy that would also define what is a water smart city. The government will need to show it is serious by putting in place rainwater harvesting and groundwater recharging systems at ALL government buildings and lands across the country and show that these are functioning.
The government will also need to bring back the watershed development as the focus of its work on water conservation and reverse the wrong steps this government took five years back (see the detailed report below).
The government also needs to urgently start work on restructuring of water institutions of India, starting with CWC. Unless people see the government’s seriousness through actions, the one listed here are the initial steps, there is little likelihood of credibility of what the government says.
With rainfall in June 2019 during the South West Monsoon already showing a deficit of massive 33%, the fifth highest deficit in last 100 years, its possibly the most opportune time to take these steps on URGENT BASIS.
