IMD is happy to declare a monsoon as normal as long as total quantum of rainfall at national scale is within 4% of what is defined as normal monsoon rainfall during June 1 to Sept 30. Even if this means there is spatially or temporally or both spatially & temporally, the total rainfall or its distribution is abnormal in large parts of the country. It was good to see a national newspaper, asking question if the monsoon is normal even though it’s not temporally normal as was the case in large parts of the country this year.
The IMD normal only assures meteorological normal of national monsoon rainfall within given period. It does not assure hydrologic normal nationally or in different parts of the country, nor agricultural normal rainfall nationally or in different parts: sub divisions, states, river basins, districts, talukas/ tehsils or villages and wards. We clearly need much more realistic and nuanced definition of even meteorological Normal monsoon rainfall, which IMD needs to work on. India’s environmental Legal system is in deep trouble. Ritwick Dutta shows this through two brilliant articles, but this is also apparent from the failure of pollution control mechanism and people, rivers and environment continues to suffer as is apparent from the poisonous Hindon river basin water that people of over a hundred villages are forced to drink while the cases have been going on in National Green Tribunal. The Yettinahole verdict of the Supreme Court now and NGT earlier seem to have completely ignored all the illegalities and falsehoods involved in the case. The verdict thus also ignored the severe vulnerabilities of the Western Ghats that is getting worse with such mindless developmental interventions. And the government seems happy to destroy the independence status of the NGT through problematic appointments, as Ritwick Dutta shows through another article. What is the hope when the judiciary itself is blind to such glaring disasters?
Following death of Swami Gyan Swaroop Sanand (Prof G D Agarwal) while on fast unto death on Oct 11, 2018 and disappearance of Swami Gopal Das ji from AIIMS-Delhi, Swami Aatmabodhanand ji has been on fast unto death at Matri Sadan, Haridwar since Oct 24, 2019. In a letter to the Prime Minister on April 19, 2019 he has said that if the government does respond by April 25, 2019 to the four demands for which the fast undo death is undertaken, he will leave water from April 27, 2019. The four demands are well known:
- Cancel all under construction and proposed dams on Bhagirathi, Alaknanda and their tributaries.
- Prohibit all mining and tree cutting in the Ganga flood plains, particularly in Haridwar
- Enact Ganga Act for the preservation of River Ganga, the draft of which has been sent to the govt.
- Constitute an autonomous Ganga Council
In its latest report, the Comptroller and Auditor General (CAG) has questioned implementation of sixteen National Irrigation Projects. Before this, the CAG has held mismanagement in dams’ operation responsible for Chennai floods in 2015. Both these reports are available on its website now.
The CAG report on National Irrigation Projects, tabled in Parliament on July 20, has revealed that sixteen major multi-purpose water projects, taken up on an expeditious basis about a decade ago, are nowhere near completion, with no work being undertaken in as many as 11 projects despite the incumbent govt’s much-wanted focus on improving irrigation facilities in the country.
The report also mentioned that out of the 16 projects, undertaken under the Accelerated Irrigation Benefits Programme (AIBP) in Feb 2008, only five projects with estimated irrigation potential of 25.10 lakh hectares were under implementation and even these projects suffer from 8 to 99 per cent shortfall in physical progress, the CAG said. The remaining 11 projects with estimated irrigation potential of 10.48 lakh hectares are yet to commence and are at different stages of approval.

In a remarkable development, the National Green Tribunal (NGT) on October 24 has suspended the clearances given to the 1750-megawatt (MW) Demwe Lower Hydroelectric Project (HEP) planned on the Lohit river in Arunachal Pradesh.
In its detailed order, released on October 27, the NGT ruled that the Environment Minister as Chairperson of the National Board for Wildlife (NWBL), a statutory body constituted under the Wildlife Protection Act, 1972, could not “just brush aside” the views of the majority of NBWL standing committee members.
Suspending the clearances given by the Centre and the state govt, the NGT order added that “the decision taken by the Standing Committee is not in accordance with established principles of law and hence the Standing Committee shall reconsider the issue and pass appropriate orders within a period of six months from the date of the judgment”.
Environmental clearance for the project was given by the Union environment ministry’s Expert Appraisal Committee (EAC) for river valley and hydroelectric projects back in 2009. An in-principle forest clearance for the Lower project was given in February 2012 and agreed upon in 2013.
However, the in-principle clearance of the project was opposed by a majority of the Standing Committee of the NBWL but subsequently cleared by the then-environment minister of state (independent charge), Jayanthi Natarajan, who was also the chairperson of the Standing Committee.
Natarajan is currently under the CBI’s scanner for alleged anomalies in clearance given for diversion of land in Saranda forest in Singhbhum district, Jharkhand to mining company Electrosteel during the previous UPA regime.
The NGT said that it is “of the view that either the Chairperson (Natarajan) should have given a proper reason for rejecting the objection of the majority of the non-official members or the decision ought to have been arrived at based on the opinion of the majority of the members. Even though the Standing Committee is a recommendatory body, the same being a statutory committee, is bound by the laudable principles of justice and fair play”.
On May 4-5, 2016, Lok Sabha Speaker Smt Sumitra Mahajan took the lead in organising a workshop for Members of Parliament on Drought, Agrarian Crisis and ILR. As part of the newly constituted Speaker’s Research Initiative’s (SRI for short) work, Smt Mahajan inaugurated the workshop at 4 pm on May 4, 2016, where a panel of eight speakers were invited (4 on each day, SANDRP coordinator was one of the invited speakers on 1st day) to share their views, followed by questions from Members of Parliament. The idea was that on these important issues, Parliament Members are better equipped to raise the relevant issues when debating and raising questions in Parliament. It was heartening to see that at least 90 MPs (88 from Lok Sabha and 2 on Rajya Sabha) were present for 2.5 hours on first day, and they wanted to ask so many questions that there was not sufficient time to allow all of them to ask, nor sufficient time for speakers to make full presentations or answer all the questions. Similarly on second day too Speakers showed lot of interest on these issues. While inaugurating the workshop, Smt Mahajan mentioned how in Solapur, Maharashtra, because of the work of the collector and his team of officials, the impact of drought is lower than that in other districts. This was certainly heartening since it was SANDRP Associate Coordinator Parineeta Dandekar who first wrote on this issue, following her visit to Solapur and interview with the district collector. The workshop highlighted the need for many such workshops, possibly more focussed, but the impact of the workshop was already visible in the (as yet unfinished) debate under section 193 that started in Lok Sabha on May 5, 2016, hopefully to be continued in current week.
