Dr Ravi Chopra, Chairman of the Supreme Court appointed High Powered Committee has hit the nail when he questioned if there is any rule of Environment Law for the Ministry of Road Transport and Highways in their implementation of the Char Dham Highway in Uttarakhand. One hopes the Supreme Court does stand up for the Rule of law SOON and takes strictest action against violations. The violations are also affecting the people, the Himalayas and even the Ganga River, in its birth place. There is not too much hope from the Environment Ministry, but one hopes the Supreme Court does stand for the Rule of Law.

PATODI JOHAD: Narela Youth Rejuvenate a dry Pond
The monsoon rains of August 2020 have brought a soothing smile on the faces of villagers working towards revival of Patodi Johad a traditional water body in Narela, a bustling sub-city in North Delhi.
The greenery, cleanliness created over past one year around the pond with joint effort by youth, women, elderly and children have been now complemented by rainwater flooding the pond making it one of best locations in Narela where native plants, water body, blooming garden is thriving.
The sustained efforts by the villagers have not only brought positive change in society by involving people of all ages, but also leading to rebuilding of lost eco-system and improving micro climate. The biggest benefit is slow but sure improvement in ground water table. This account presents glimpses of how this happened.

DRP: 24 August 2020: Janta Parliament discusses some serious water issues
While Indian Parliament has not met since March 2020, Civil Society Groups came together and held a Janta (people’s) Parliament from Aug 16 to 21 Aug 2020, where citizens from across the country from all walks of life enthusiastically participated. On Aug 18 there was a three hour session on Environment issues (such a session is a rarity in Indian Parliament), as part of which, there was a presentation on Water related issues where SANDRP coordinator was invited to speak. Two water related resolutions were passed among others, by the Janta Parliament, one on Flood Management and another on Urban Water Management. See below for details.

DRP: 17 August 2020: The Contempt of Court case against MoEF

This last week, one Contempt of Court case was deservedly in news, when on the eve of India’s 74th Independence day, the apex Court found public spirited Prashant Bhushan guilty of contempt of Court. Prashant Bhushan’s commitment for the cause of the people and responsible governance of various institutions is beyond question. He is known for being critical of the government and judiciary’s track record and is supported in this by most independent minded persons.
However, there was another contempt case this last week, related to environmental issues, that was not so much in the news. On June 30, 2020, Delhi High Court bench of Chief Justice D N Patel and Justice Prateek Jalan in response to petition by environmentalist Vikrant Tongad had directed, among other things, that Union Ministry of Environment and Forests (MoEF) should translate the Draft EIA (Environment Impact Assessment) Notification of 2020 into all the official languages of India and disseminate widely in ten days. DRP: 10 August 2020: CANCEL EIA 2020!
Anyone who cares for India, its people and their future and who even remotely understands environmental governance and democratic process will come to just one conclusion about the Draft EIA (Environment Impact Assessment) 2020: CANCEL IT.
We certainly need change in the current EIA process. The whole thing is a major fraud at every stage, from the exclusion from large number of activities from the scope of EIA process, to scoping to quality of EIA, to the track record of the EIA consultants, to the process of selection of EAC (Expert Appraisal Committee) and its functioning, to public hearing and consultation process, to the complete absence of capacity or even will to monitor and achieve compliance of the approved project, every step needs strengthening, from the current EIA process based on the 2006 notification.

DRP: 03 Aug 2020: India needs to demand info from China on Brahmaputra issues
Two important developments this week underline once again the need for Indian govt to demand clear responses from China. One is about the threat of landslide outburst flood that may enter India via Siang. A landslide dam has been formed on the Jianpu glaciers that feeds the Yigong Tsangpo, a tributary of Yarlung Tsangpo, as Siang is known by that name in Tibet. This landslide dam can breach anytime, and bring a high wave of sudden & destructive flood in Arunachal Pradesh. Chintan Sheth, who monitors this area through use of satellite imagery, has once again (his warnings on such landslide outburst dams in the past has been very accurate and useful) warned us about this through an excellent and detailed article quoted below, in Arunachal Times. Such information should actually be coming from Govt of India’s elaborate satellite imagery capabilities. At least now the Govt of India needs to ask China to share all information about this landslide dam and share that information with the people of Arunachal Pradesh at greatest risk due to such floods.

Uttarakhand: Finally, Yamuna illegal bridge gone. But will govt learn?
Finally, Uttrakhand government on July 25, 2020 has removed illegal mining bridge on Yamuna river in Haripur, tehsil, Dehradun. The bridge across the Yamuna River was built by the illegal sand miners on culvert pipes in the last week of May 2020 hindering the river flows. It is not clear if the state government took any punitive or deterrent steps against those responsible, or did the government just quietly removed the bridge at its own expenses.

But Why Did Sen Nursing Drain Breach?
On the intervening night of July 18 and 19, Delhi received heavy rainfall spell leaving several areas water logged. In the afternoon of July 19, a video went viral on social media showing collapse of houses along Sen Nursing Nala at ITO, Delhi.
The incident happened due to a breach in right bank of storm water drain at the back of WHO building reportedly damaging about 12 houses of Anna Nagar, a fifty years old slum area located along the left bank of the drain.
Delhi Drinking Water Canal gets toxic mix
In May 2019 SANDRP wrote, with photo evidence, after a visit to the Drain No 8 that brings Delhi’s drinking water that it is running next to drain no 6 carrying untreated industrial toxics from Haryana, with only sand bags separating the two. A visit on 21st July, 2020 provided video proof that water from drain no 6 is still happily mixing with drain no 8 at several places.
A visit to drain number 8, one of prominent canal carrying potable water supply of national capital can be shocking experience to anyone concerned with water quality and health of people. The canal (called escape) flows close to Delhi Haryana border in Sonipat district. The drinking water in the escape is being repeatedly contaminated with all sorts of industrial effluents.

Bihar Sand Mining 2020: Ruining rivers; aggravating floods

The 2018 review of sand mining[i] for Bihar highlighted how mismanagement by govt and then National Green Tribunal (NGT) ban on sand mining in Ganga river, Son rivers particularly during monsoon months resulted in sand scarcity and soaring prices affected public and livelihoods of mining laborers.
The video report featuring local people revealed that illegal mining was causing floods in West Champaran by damaging embankments. Similarly, the report on Gaya mentioned sand mining among reasons behind increasing air pollution. The death of four kids by drowning into sand mine pits was shocking. This compilation presents the situation after 2018 so far.
