DRP 180923: Floodplain loss, the biggest in Asia, disaster in the making

A floodplain, according to the US Federal Emergency Management Agency, is “any land area susceptible to being inundated by floodwaters from any source”. According to the report “Human alterations of the global floodplains 1992–2019”, over 460,000 sqkms of floodplain area was lost to agriculture, while another 140,000 sqkms was redeveloped to new areas over the existing floodplain. Continent-wise, Asia lost the biggest area of floodplains — a little over 200,000 sqkms — among all the continents. It was followed by South America (92,000 sqkms) and Africa (73,000 sqkms).

DRP 110923: Another independent institution-CEC destroyed

The Govt of India’s Sept 5 2023 notification reconstituting the Central Empowered Committee completely destroys the independent nature of this institution of accountability and course correction. This institution, set up by the Supreme Court in 2002 and reconstituted in 2008, worked as eyes and ears of the Supreme Court on environmental issues. The new committee has no independent members, it will be constituted by the MoEF, MoEF itself has such an abysmally poor track record.

The notification, reports said, diluted the CEC’s autonomy on four key counts: the committee will report to the ministry, instead of the SC; the ministry will pick all the members and the SC will have no role in the process; the ministry, and not the court, will fund the committee; the provision of having two NGOs in the committee has been done away with.

DRP 140823: A year after Karam dam disaster: people suffer, engineer set free, contractor building more dams

It was on Aug 13, 2022, a year ago when the Karam dam wall in Dhar district in Madhya Pradesh started leaking water. Two days later it collapsed. The people who suffered during the disaster continue to suffer. The engineers who were supposed to ensure proper construction of the dam, following all the norms, did not do that, were supposed to be suspended, but got reinstated elsewhere. They kept quiet in the courts. The black listed contractor continues to build more dams.

A clearer evidence of the nexus that supports unwanted, destructive, costly, corruption ridden and disastrous dams would be difficult to find. As the destruction due to dams and such other unaccountable infrastructure development plays out in Himachal Pradesh & elsewhere this year, the nexus that thrives on opaque, unaccountable and non-participatory governance continues to happily grow even as the changing rainfall patterns bring greater disasters before our eyes.

DRP 070823: Forests & Biodiversity amendments: Gap between intent & application

As editorial comments in two different national newspapers given below shows, the biodiversity and forest conservation amendment bills passed by the Parliament last week weaken the cause of biodiversity and forest conservation, when it is most pressingly required to strengthen them.

Both amendments pave the way for ease of doing business and reducing role of local communities, both in terms of legal norms and practical implications.

The need for conservation of these resources was never more urgent than now considering the impacts of climate change on them and their importance for not only livelihood security of vast millions, but also for hydrological implications, food security, protection against increasing frequency and intensity of disasters, but also for adaptation in the context of changing climate. We hope against hope that better sense will prevail sooner rather than later to ensure the amendments do not lead to destruction of forest and biodiversity resources.

DRP 310723: Disastrous SHORT TERMISM in Urban India

The Supreme Court’s notice on Shimla development plan that lacks balance between development and environment is welcome and one hopes the apex court takes the issue to its logical conclusion. The consequences of unplanned and ill planned urban developments are a clear invitation to major disasters, including floods, landslides, traffic congestions, air and water pollution, health hazards and also water shortages. The Shimla Master plan also violates the NGT directions with complete impunity.

This is exactly what the EDIT in the Times of India on Mussoorie misery, dangerous short termism that pervades across sectors in Urban India with no policy to guide Urban Water sector or for that matter any other sector.

DRP 150523: Will the govt listen to caveats against Ken Betwa Project?

The following report raises three caveats regarding Ken Betwa River Link Project, among others. Firstly it urges that the substantial impact of climate change on the rivers needs to be taken into account, particularly the need for accurate hydrological assessment. It underlines that the project themselves are accelerating the climate change impact on monsoons as they are reducing freshwater flows to the oceans, which in turn has an impact on the ocean’s thermal and salinity gradients, both of which are drivers of monsoon.

Secondly, it rightly says that the impact of projects on adaptive capacity of areas like Bundelkhand needs to be taken into account. In Bundelkhand, climate adaptation can be harnessed using rain water harvesting, rejuvenation of traditional water systems, less water intensive crops and alternative agricultural practices. Thirdly, the water sharing issues that may worsen with both climate change and big projects, need to be kept in mind while taking up mega projects, particularly its impact on water and other security issues.

DRP 24X22: Stay on Shimla Draft Development Plan 2041 A Right Step by NGT

In a welcome development, National Green Tribunal (NGT) has put Shimla Draft Development Plan (SDDP) 2041 on hold finding it ill-conceived and in directly violation of its earlier order of regulating haphazard construction activity in the state capital. This is a major set back of present government which had been hoodwinking the judiciary to provide relief to unauthorized structures with Shimla Planning Area in view of upcoming state assembly election.

To push the SDDP, the government went on to challenge NGT’s judicial power and even approached Supreme Court and chose to ignore the principle of sustainable development. The NGT order is a validation of the crusade launched by environmentalists and social organizations to save the Queen of Hills from further concretization and degradation.

The government has failed to get any relief from NGT, High Court and Supreme Court on the issue. Its time, the government wake up to the gravity of concerns and fragility of the hill station which has also been struggling to meet potable water demand and performing poorly on solid and liquid waste treatment front.

Jal Jeevan Mission (JJM) one of flagship schemes of Central Government aiming to provide tap connection to every households in the country by 2024 has been affected by financial constraints as per the statement of Gajendra Singh Shekhawat, the Jal Shakti Minister published in an interview to the Live Mint on May 16, 2022. The Minister has also admitted that the progress of work has suffered due to inflation in commodity prices.

There can be some truth to the Jal Shakti Minister’s claim that ‘commodity super cycle’ slowing down the implementation of JJM. But a closer look reveals that blaming ‘commodity super cycle’ for slowing down of the project is also a convenient way to deflect attention from poor policy planning and execution that has marked the JJM project.

DRP: 14 Dec 2020: Constitution of EAC for River Valley Projects Challenged in High Court

The Karnataka High Court has taken up the petition challenging the constitution of the Expert Appraisal Committee (EAC) on River Valley and Hydropower projects. Notices have been issued to MoEF and also all the members of EAC on a petition filed by the United Conservation Movement Charitable Welfare Trust. Such a scrutiny of the appointment of the EAC was long overdue and urgently required. One hopes the High Court will take the matter to its logical conclusion and ensure that MoEF has a credible, transparent process of appointment of these committees as without such a process, the MoEF gets away with appointing only yes people on the committee who are happy to tow the government line. That nullifies the whole purpose of the constitution of the committee, the EIAs, the public consultations, the appraisals, the clearances and even credible monitoring and compliance. It is complete failure of environment governance and laws and MoEF even gets away with appointment of people with clear conflict of interest. MoEF has no process of selection of the chair and members of these committees. Hoping for the best for the case to correct all this.

DRP: 30 Nov 2020: J&K SEAC denies EC to sand mining

In otherwise bleak governance of sand mining in India, J&K State Expert Appraisal Committee (SEAC) has denied environment clearance to sand mining projects on Jhelum river, since the proposals were not in conformity with the MoEF’s 2016 Sand Mining Management Guidelines, involved in-stream mining, did not have proper District Survey Reports, proper Sand Mining Plan or Replenishment studies. One hope this is emanating from genuine concern for proper governance and this needs to spread to more areas so that at least the guidelines get properly implemented.
